Acceptance of Terms

By accessing and using the website and services of Cross Collar Jiu Jitsu ("we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree, please do not use our website or services.

Services

Cross Collar Jiu Jitsu provides Brazilian Jiu-Jitsu, wrestling, and MMA instruction and related services at our Seabrook, Texas academy. Our website allows you to learn about our programs, contact our team, and optionally opt in to receive SMS/text communications.

Use of Website

You agree to use this website only for lawful purposes and in a manner that does not infringe upon the rights of others. You are responsible for ensuring that information you provide is accurate and complete, and that any phone number you submit belongs to you or that you are authorized to provide it.

User Consent for SMS Communications

Our SMS program is a mixed use case program consisting of two independent message categories, each requiring its own separate, unchecked opt-in checkbox:

• Transactional/informational messages: class schedule changes, membership updates, appointment reminders, and customer care.
• Promotional/marketing messages: seminars, camps, special offers, and academy events.

Consent is never pre-checked, never bundled with acceptance of these Terms, and never required to submit our contact form. Only the person who owns the mobile number may provide consent, and consent for a minor's account must be given by a parent or legal guardian.

Message Frequency & Charges

Message frequency varies based on your account activity and the message categories you opted into; you may receive up to 10 messages per month across both categories. Message and data rates may apply according to your wireless carrier plan. Cross Collar Jiu Jitsu is not responsible for any charges incurred from your carrier.

Opt-Out Procedures

You may stop receiving text messages at any time by replying STOP or UNSUBSCRIBE to any message you receive from us. You will receive a one-time confirmation message and no further messages from that program. Opting out of promotional messages does not automatically opt you out of transactional messages, and vice versa — each category can be managed independently. SMS Liability & Disclaimers

Cross Collar Jiu Jitsu is not responsible for delays, failures in delivery, or other issues related to the transmission or receipt of text messages. Delivery is subject to effective transmission by your mobile carrier and is not guaranteed. Carriers including AT&T, Verizon, T-Mobile, and others are not liable for delayed or undelivered messages.

By subscribing to our SMS services, you acknowledge and agree that Cross Collar Jiu Jitsu will not be liable for any damages, losses, or injuries arising from or related to the use of or failure to receive any text messages, including but not limited to delays, non-delivery, or technical issues. Your use of our SMS services is at your own risk, and we provide our SMS messaging services on an "as-is" basis without any warranties of any kind, express or implied.

Regulatory Compliance

We comply with the Telephone Consumer Protection Act (TCPA), CTIA Messaging Principles and Best Practices, and all applicable federal and state regulations governing SMS communications.

Data Security & Information Handling

Cross Collar Jiu Jitsu is committed to protecting the security of your personal information. We implement reasonable security measures to safeguard your information against unauthorized access, use, or disclosure. However, no method of transmission over the Internet or mobile networks can be guaranteed to be 100% secure.

Assumption of Risk

Martial arts training involves inherent physical risk. All participants must complete a waiver before training. Participation is at your own risk, and you should consult a physician before beginning any training program.

Limitation of Liability

Cross Collar Jiu Jitsu shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of this website or services.

Intellectual Property

All content on this website, including text, graphics, logos, and images, is the property of Cross Collar Jiu Jitsu and is protected by applicable intellectual property laws.

Additional SMS Terms

Our SMS/text messaging programs are additionally governed by our SMS Terms & Conditions and our Privacy Policy. By opting in, you agree to those terms in addition to these Terms of Service.
